Personal Usage License Agreement for Music

This Personal Usage License Agreement (“Agreement”) is entered into between Zick Zack ENT, referred to as the “Licensor,” and the purchaser, referred to as the “Licensee,” collectively referred to as the “Parties.”

1. Grant of License:

Licensor grants Licensee a non-exclusive, non-transferable license to use the music tracks (the “Music”) purchased through [Your Website] for personal and non-commercial purposes. This license allows Licensee to incorporate the Music into videos, podcasts, presentations, and other creative projects for their personal enjoyment.

2. Permitted Usage:

Licensee is permitted to use the Music in the following ways:

Incorporating the Music into personal videos and multimedia presentations.
Using the Music in personal podcasts, live streams, and online videos intended for non-commercial audiences.

3. Prohibited Usage:

Licensee is expressly prohibited from the following:

Reselling, distributing, or otherwise making the Music available as standalone tracks.
Using the Music in projects intended for commercial purposes, including advertisements, films, video games, and other revenue-generating activities.
Modifying, altering, or adapting the Music without prior written consent from Licensor.

4. Ownership and Copyright:

The Music remains the intellectual property of the Licensor. This license does not transfer any ownership rights or copyrights of the Music to the Licensee. Licensee shall not claim ownership of the Music or register it as their own work.

5. Attribution:

While not required, Licensee is encouraged to provide proper attribution to the Licensor when using the Music in their projects. Attribution should include the Music’s title, authorship, and a link to the original purchase page on www.zickzackent.co.za

6. Copyright Infringement Fees:

In the event of copyright infringement by the Licensee, they shall be liable to pay a mandatory fee of $10,000 to the Licensor. Additionally, Licensee shall bear all legal fees incurred by the Licensor in enforcing and claiming copyright infringements.

7. Termination:

This license is effective until terminated. Licensor reserves the right to terminate this license if Licensee breaches any terms of this Agreement. Upon termination, Licensee must cease all use of the Music and destroy any copies of the Music in their possession.

8. Governing Law:

This Agreement shall be governed by and interpreted in accordance with the laws of South Africa. The Parties agree that any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in South Africa.

9. Applicability to Music Formats:

This Agreement applies to the purchase and usage of Singles, EPs, LPs, and Albums and any other music available for sale and or download on www.zickzackent.co.za

10. Entire Agreement:

This Agreement constitutes the entire understanding between the Parties concerning the subject matter herein and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.

By purchasing and using the Music, Licensee acknowledges that they have read and understood this Agreement and agree to be bound by its terms.
